Currys welcomes you to “Our Lives”, our Photo and Video competition. These are our terms and conditions for use of the website. These terms and conditions apply whenever you access the website, on whatever device. In these terms and conditions, when we say “Our Lives”, we mean this website, regardless of how you access it. By using the website, you are deemed to have accepted these conditions.

Some areas of “Our Lives” require registration. By completing the initial registration form and by entering your email address and password, you will be deemed to have accepted these terms and conditions. Also, by subscribing to any of our email services, you are deemed to have accepted these terms and conditions. If you register with “Our Lives”, you should read our privacy policy which can be found at www.currys.co.uk/martprd/editorial/privacy_policy

If you have registered with us and subsequently change your details, you should immediately notify us of any changes by altering them on the “My Account” section of our “Our Lives”.

Any changes we make to the terms and conditions will be reflected on this page.

  1. “Our Lives” competition: terms of entry

    The Promoter of this competition is DSG Retail Limited trading as Currys, a company registered in England whose registered office is at Maylands Avenue, Hemel Hempstead, Herts, HP2 7TG and whose company number is 504877. Please DO NOT send entries to this address.

    The competition is open to entrants who are individuals and residents of the United Kingdom who are aged 16 and over. The competition is not open to professional photographers, employees of DSG Retail Ltd or its group of companies, nor to employees of The Guardian Media Group Limited, PMA Marketing Limited or any of their consultants and agents or anyone else professional associated with this competition (all such persons to be known as “Connected Persons”).

    However, Connected Persons may upload photographs onto “Our Lives” for fun and those photos will be able to receive ratings from other “Our Lives” users although they will not be eligible for official entry into the competition.

    All competition entries must be uploaded to the “Our Lives” website; www.currysourlives.co.uk.

    The closing date for entries is 23.59 hours on 31st July 2008. Postal entries will not be accepted.

    Entry to the competition is free. You will not be paid for any entries into the competition. Entrants must fully complete the registration process on “Our Lives”, as detailed in clause 4 below.

    Each individual entrant may enter a maximum of 20 photo uploads and 5 video uploads for the “Our Lives” competition.

    Bulk entries made from trade, consumer groups or third parties will not be accepted.

    Entries posted in breach of these terms and conditions of use will be invalidated and removed from the competition.

  2. Selecting and announcing the finalists and winner of the competition

    The competition is split into five categories: Our People, Our Places, Our Events, Our Environment and Our Lives in Motion. There will be a finalist selected from each of these categories.

    As soon as possible after the closing date (31.07.08), the panel of judges will announce the finalists.

    The finalists and a selection of the entrants’ videos or photographs will be exhibited at the Mall Galleries in central London and the exhibition will be called the “Our Lives Exhibition”.

    Within two weeks of the closing date, the finalists will be notified of their prize and that their entry will be exhibited at the “Our Lives Exhibition” either by an e-mail to the e-mail addresses submitted on their registration form, or via telephone, depending on the preferred contact method as indicated in the registration process.

    The “Our Lives Exhibition” will take place between the 9th and 16th August 2008. On the 16th August 2008, a presentation evening will be held and the overall winner will be announced and finalist prizes awarded. All finalists will be invited to attend the presentation evening in the Mall Galleries at their own cost.

    The judges’ decisions are final and no correspondence will be entered into.

  3. Competition prizes

    Prizes for the “Our Lives” competition are as follows:

    Winner’s prize: 1 x 14 night holiday for 2 people up to a maximum value of £8,000 including flights, transfers and accommodation on a bed and breakfast board and VAT (excluding travel insurance and transfers within the UK). The holiday location must be selected from a list determined by DSG Retail Ltd and provided to the winner. The holiday must be taken by 31st December 2009 and if cancelled for any reason at any time by the winner, cannot be re-booked. To the extent the holiday value exceeds the prize value of £8,000; the winner must pay for the excess. To the extent the full prize value is not used, the balance will lapse.

    Other prizes: 4 x Panasonic Digital Cameras and 1 x Panasonic Camcorder.

    Subject to DSG Retail Ltd reserving the right to substitute a prize with another of equal or greater value, prizes are as stated and cannot be modified, substituted for a cash payment or transferred to another person.

  4. Registration on “Our Lives”

    When you register, you are registering as a personal user of “Our Lives”. Access to registration areas is via your username and password.

    We allow you access to the registration areas of the site on the basis that:

    1. your email address and password are personal to you and may not be used by anyone else to access “Our Lives”;
    2. you will not do anything which would assist anyone who is not a registered user to gain access to any registration area of “Our Lives”;
    3. you do not maliciously create additional registration accounts for the purpose of abusing the functionality of the site, or other users; nor do you seek to pass yourself off as another user
    4. you accept and comply with these terms and conditions.

    If, for any reason, we believe that you have not complied with these terms and conditions, we may, at our discretion, cancel your access to the registration areas of “Our Lives” immediately and without giving you any advance notice.

  5. Termination of registration

    If we wish to bring your registration with “Our Lives” to an end, we will do so by emailing you at the address you have registered stating that your registration has terminated. Your registration will terminate and your email address and password will become invalid on “Our Lives” immediately.

  6. Use of Material appearing on “Our Lives”

    For the purposes of these terms and conditions, "Material" means material including, without limitation, text, video, photography, graphics and sound material, published on the “Our Lives” website, whether copyright of Currys or a third party.

    You may download and print extracts from the Material and make copies of these for your own personal and non-commercial use only. You must not download or print the Material, or extracts from it, in a systematic or regular manner or otherwise so as to create a database in electronic or paper form comprising all or part of the Material appearing on “Our Lives”.

    You must not reproduce any part of “Our Lives” or the Material or transmit it to or store it in any other website or disseminate any part of the Material in any other form, unless we have expressly given permission for you to do so.

  7. Disclaimer of liability

    To the extent permitted at law, we do not accept any responsibility for any statement in the Material. We make no representations or warranties as to the accuracy, reliability or completeness of any of the Material on “Our Lives”.

    You must not rely on any statement we have published on “Our Lives” without first taking specialist professional advice. Nothing in the Material is provided for any specific purpose or at the request of any particular person.

    For the avoidance of confusion, we will not be liable for any loss caused as a result of your doing, or not doing, anything as a result of viewing, reading or listening to the Material or any part of it (except for death or personal injury attributable to our negligence and to the extent permitted at law).

    You may access other sites via links from “Our Lives”. These sites are not under our control and we are not responsible in any way for any of their contents.

    We give no warranties of any kind concerning “Our Lives” or the Material. In particular, we do not warrant that “Our Lives” or any of its contents is virus free. You must take your own precautions in this respect as we accept no responsibility for any infection by virus or other contamination or by anything which has destructive properties.

    We do not accept any responsibility for competition entries which are lost, delayed or incomplete.

  8. Submitting Material for publication on “Our Lives”

    Users of “Our Lives” may submit Material for publication in various areas of the site, including on the voting and message board services.

    When you submit text or send a photograph or other Material to ”Our Lives” you do so in accordance and in deemed acceptance of these terms and conditions, and in particular, on the basis that:

    1. You warrant that you have taken the photograph(s) / video footage you have sent to us or you have permission from or are authorised by the owner of the photograph(s) to send it (them) to us;
    2. You warrant that you, or the person on whose behalf you have permission to submit the Material, owns the Copyright and other relevant rights to the Material.
    3. You grant us a worldwide, non-exclusive, perpetual, royalty-free licence to publish or otherwise use the Material in any way, for a purpose connected with the photo and video competition on our “Our Lives”;
    4. Selected photograph and video Material will be published at the discretion of the editor and you will not be paid, even if your submission(s) is (are) published;
    5. We may cut, edit, crop or arrange your photograph(s) or video as we think fit;
    6. We may remove your photograph(s) or videos from the “Our Lives” website at any time;
    7. Your name will be published alongside your photograph(s) or video(s), but we may edit or delete any comments which you submit along with your photograph(s) or video(s) should we deem them as not suitable for publication;
    8. Publication of any text you submit to us will be at the sole discretion of the editor and we reserve the right to make additions or deletions to the text prior to publication, or to refuse publication;
    9. You warrant that the Material you submit is not obscene, offensive or defamatory of any person or otherwise illegal;
    10. You agree not to submit Material on “Our Lives” which is deliberately intended to upset other users;
    11. You acknowledge that any breach of these warranties may cause us damage or loss and you agree to indemnify us in full and permanently against any third party liabilities, claims, costs, loss or damage we incur as a result of publishing Material you submit to us, including consequential losses;
    12. We reserve the right to remove your registration completely if we believe you are abusing “Our Lives” in any way.

    IMPORTANT: You or the owner of the photograph(s) / video(s) still own the copyright in the photograph(s) / video(s) sent to us and are free to republish the photograph(s) / videos(s)wherever you or the owner wish and in whatever medium you or the owner want.

  9. Data protection

    If you have indicated on the registration form that you wish to receive direct marketing material, your personal details will be included in a database compiled for direct marketing purposes. From time to time, you may receive direct marketing information from us or from third parties.

    If you have indicated that you wish to receive email updates only from “Our Lives”, your personal details will be included on a database compiled for this specific purpose.

    If you have indicated that you wish to receive direct marketing material or email updates from “Our Lives” but subsequently change your mind, you should notify the user support team at www.currys.co.uk. As soon after your notification as is reasonably practicable, we will remove your personal details from the relevant database(s).

  10. Variations

    These terms may be varied from time to time. Please ensure that you review these terms and conditions regularly as you will be deemed to have accepted a variation if you continue to use the site after it has been posted.

  11. Force majeure

    Although we will do our best to provide constant, uninterrupted access to “Our Lives”, we do not guarantee this. We accept no responsibility or liability for any interruption or delay to the website or services.

  12. Governing Law & Jurisdiction

    This agreement is governed by English law and the parties agree to submit to the exclusive jurisdiction of the English courts.
